Terms of Service

These terms explain the rules for using Canvix.io, including our AI tools, image tools, web tools, accounts, credits and subscriptions.

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Canvix.io website, the online image editor, and all related tools, features and services (collectively, the "Service") operated by Canvix.io ("we", "us" or "our").

By creating an account, accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Eligibility

You may use the Service only if:

  • you are at least the age of digital consent in your country (and in any event at least 13 years old); and
  • you have the legal capacity to enter into a binding contract.

If you are using the Service on behalf of a company or other legal entity, you represent and warrant that you are authorised to accept these Terms on its behalf, and that the entity accepts these Terms.

3. Accounts

To access certain features (for example saving templates, using Pro tools, or managing projects) you may need to create an account.

When creating an account, you agree to:

  • provide accurate, current and complete information;
  • keep your login credentials secure and confidential; and
  • be responsible for all activity that occurs under your account.

3.1 Communications

By creating an account, you agree that we may send you important administrative messages about your account or the Service (for example, billing notices, security alerts or service changes). You may also choose to receive newsletters or promotional emails, which you can unsubscribe from at any time using the link in those emails.

4. Subscriptions, Fees and Billing

We offer a free tier with limited functionality and a paid "Pro" subscription that unlocks additional features (for example AI image generator, AI background remover, and Pro templates).

  • Recurring billing. Unless otherwise stated, Pro subscriptions are billed on a recurring basis (e.g. monthly) until cancelled. The current price is $10 USD per month (or equivalent in your local currency if applicable), but we may update pricing from time to time.
  • Payments. You authorise us and our payment processors to charge your selected payment method for subscription fees, taxes and any other charges incurred in connection with your account.
  • Price changes. We may change subscription prices and will give notice where required by law. Changes will apply from the next billing period.
  • Cancellation. You can cancel your subscription at any time from your account settings (or by contacting us). Cancellation will take effect at the end of the current billing period. You will continue to have access to Pro features until that date.
  • Refunds. Unless required by applicable law, all fees are non-refundable and we do not provide refunds or credits for partial subscription periods.

4.7 Payment Processing

Payments are processed securely by third-party payment providers such as Stripe or PayPal. We do not store and do not have access to your full payment card details. Your use of these payment processors is subject to their own terms and privacy policies in addition to these Terms.

5. Description of the Service

Canvix.io is an online design and image editing platform that runs in your browser. The Service may include, among other things:

  • A canvas-based editor using Fabric.js and custom editing tools.
  • Drawing tools, including pencil and eraser.
  • Image tools such as brightness, contrast, hue, saturation, grayscale, glow, pixelate and other effects.
  • A layers panel allowing you to change object order (front/back) and manage design layers.
  • Options to upload images from your device and insert them into the editor.
  • An option to insert images via URL, allowing you to paste an image link from the internet and place that image on the canvas (subject to your having the necessary rights).
  • An integration with Pixabay that lets you search thousands of stock images and add them to your design.
  • An "Elements" section where we provide locally hosted vectors, PNGs and other graphics for use in your designs.
  • AI-powered tools such as AI image generation and AI background removal (including on uploaded images and newly generated images).
  • A YouTube thumbnail import feature where you can paste a YouTube video URL and import available thumbnail images to edit.
  • The ability to save templates (for example as JSON data in our database) to your account, and export/download designs as PNG, JPG or PDF.

We may add, change or remove features over time. We do not guarantee that any particular feature (including AI tools, Pixabay integration, YouTube thumbnail import, or specific export formats) will always be available.

5.3 Service Availability

We aim to keep the Service available and running smoothly, but we may occasionally carry out maintenance, updates or other changes that can temporarily interrupt access. The Service may also be unavailable due to technical issues or events outside our control. We are not liable for any downtime, interruption, or loss of data arising from such events.

6. Licence to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal or internal business purposes.

You agree that you will not:

  • copy, modify, adapt, reverse engineer or attempt to extract the source code of the Service;
  • circumvent or attempt to circumvent any security or access controls, or any usage limits that we apply;
  • resell, rent, lease, sublicense or otherwise commercialise the Service or any part of it, except as permitted in these Terms;
  • use automated tools (such as bots, scrapers or crawlers) to access the Service, except via any official API that we may provide.

7. Your Content

"User Content" means any content that you upload, create, generate, import or otherwise make available through the Service. This includes:

  • images, graphics and files you upload from your device;
  • images you insert via URL;
  • templates and designs you create (including the underlying JSON template data stored in our database);
  • images generated using our AI tools;
  • YouTube thumbnails imported for editing; and
  • any text, shapes, icons, or elements that you add to the canvas.

7.1 Ownership

You retain any rights you already hold in your User Content. These Terms do not give us ownership of your User Content.

For clarity, all designs, templates and images you create using Canvix.io (including exports such as thumbnails, banners or other artwork in PNG, JPG, PDF or any other format) remain fully owned by you. We do not claim any ownership rights over your finished designs or exports. You are free to use, distribute, publish, sell or license your creations without any obligation to Canvix.io, subject only to any rights of third parties in content or assets you have used.

7.2 Licence to Us

By submitting User Content to or through the Service, you grant us a worldwide, non-exclusive, royalty-free licence (with the right to sublicense to our service providers) to host, store, process, reproduce, display and modify your User Content as necessary:

  • to provide, operate and maintain the Service;
  • to improve and develop the Service;
  • to prevent or address technical issues or security problems; and
  • to back up and restore data.

We will not use your User Content for our own marketing or promotional materials without your separate permission.

7.3 Your Responsibilities

You are solely responsible for your User Content and for your use of it through the Service.

You represent and warrant that:

  • you have all necessary rights and permissions to upload, create, import and use your User Content;
  • your User Content and your use of the Service does not infringe or violate any intellectual-property rights, privacy rights, publicity rights or other rights of any third party;
  • your User Content complies with all applicable laws and regulations.

You are strongly encouraged to download or back up your important designs and exports. We are not responsible for any loss or corruption of User Content.

7.4 Responsibility for Copyrighted and Third-Party Material

You are solely responsible for ensuring that any logos, images, fonts, branding, characters, music, videos or other copyrighted or trademarked material used in your designs are properly licensed or permitted for your intended use. Canvix.io does not monitor or verify the licence status of content you use and accepts no responsibility for any legal issues arising from your use of third-party material in your designs.

8. AI Features

The Service includes AI-powered tools, such as AI image generation and AI background removal. These features may be provided or supported by third-party AI providers.

AI outputs can be inaccurate, inappropriate, or unexpected. You are responsible for reviewing AI-generated content and ensuring it is suitable for your intended use.

You agree that you will not use AI features to:

  • generate illegal or harmful content;
  • infringe intellectual-property rights or privacy rights; or
  • engage in deceptive, misleading or unethical activities.

Subject to applicable law and any third-party terms that apply, you generally own the rights you are entitled to in AI outputs you create using the Service. However, it is your responsibility to ensure that your use of those outputs complies with all laws and third-party rights.

We may log prompts, settings and outputs for abuse detection, debugging, analytics and to improve the Service, in accordance with our Privacy Policy.

8.5 AI Content Responsibility

AI-generated images and content may occasionally contain artefacts, errors, bias or material that is unsuitable for public display. You are solely responsible for reviewing and moderating AI outputs before publishing or sharing them. Canvix.io does not endorse, verify or take responsibility for AI-generated content created by users.

9. Third-Party Content and Integrations

9.1 Pixabay

The Service allows you to search and insert images from Pixabay. Those images are provided by Pixabay under its own licence and terms, not by us. When you use Pixabay content via the Service, you must comply with Pixabay�s applicable licence and terms. We are not responsible for Pixabay�s content, availability or policies.

9.2 YouTube Thumbnails

The Service may allow you to insert thumbnails from YouTube videos by providing a YouTube link. Such thumbnails are owned by YouTube or the relevant content owners and may be subject to YouTube�s terms and copyright rules. You are responsible for ensuring that your use of YouTube thumbnails complies with YouTube�s policies and with applicable copyright law.

9.3 Images Inserted via URL

When you insert images using an external URL, you are solely responsible for ensuring that you have the legal right to use those images and that your use complies with any licence or website terms that apply. We do not verify the licence status of images inserted via URL and we are not liable if such use infringes third-party rights.

9.4 Other Third-Party Services

The Service may contain links to or integrate with other third-party services or websites. Those third parties are not under our control and we are not responsible for their content, policies or practices. Your use of such third-party services is at your own risk and may be subject to additional terms.

10. Our Elements, Templates and Assets

We may provide our own elements, vectors, icons, backgrounds, templates and other graphical assets that are hosted and served by us (collectively, "Site Assets").

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the Site Assets within the Service to create designs and to export those designs (e.g. as PNG, JPG or PDF) for your personal or commercial projects.

You must not:

  • extract or download Site Assets for the purpose of reselling or redistributing them as standalone files (for example as a stock library or asset pack);
  • use Site Assets in a way that allows others to access or use them as a replacement for our Service; or
  • use Site Assets in violation of any law or third-party rights.

We retain all rights in the Site Assets not expressly granted to you in these Terms.

11. Prohibited Uses

You agree not to use the Service to:

  • upload, create or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, hateful, discriminatory, obscene or otherwise objectionable;
  • upload, generate or share content that infringes any copyright, trademark or other intellectual-property rights;
  • upload or distribute malware, viruses or other malicious code, or attempt to interfere with or disrupt the Service or its infrastructure;
  • attempt to gain unauthorised access to the Service, other users� accounts, or any related systems;
  • scrape, harvest, mass-download or otherwise misuse content (including Pixabay content or YouTube thumbnails) in violation of third-party terms;
  • misrepresent your identity or affiliation, or falsely imply that your content is endorsed by us or by any third party; or
  • engage in any activity that violates applicable laws or regulations.

We may (but are not obligated to) monitor activity on the Service and may remove User Content, suspend or terminate accounts where we reasonably believe these Terms have been violated.

12. Storage, Templates and Data Retention

When you save templates, we may store a JSON representation and related metadata in our database (for example in a template_data field in a user_templates table or similar). This allows you to re-open and edit your designs.

We may apply reasonable limits, for example on:

  • the number of templates or projects you can store;
  • total storage capacity per account; and
  • export or download frequency.

We may delete inactive accounts or stored data after extended periods of inactivity, subject to applicable law and our data retention policies. We do not guarantee that any particular item of User Content or template will be retained or recoverable.

12.1 Data and Security

We implement reasonable technical and organisational measures to help protect the security of your account data and stored templates. However, no online service is completely secure. You acknowledge that there is a risk of unauthorised access, data loss or breaches, and you agree to use the Service at your own risk and to maintain your own backups of important designs.

13. Privacy

Our collection and use of personal data in connection with the Service is described in our Privacy Policy. By using the Service, you consent to our processing of your information as described in that policy.

14. Intellectual Property

The Service, including all software, interfaces, features, Site Assets, branding, logos and underlying technology, is owned by or licensed to us and is protected by intellectual-property laws.

Except for the limited rights expressly granted to you in these Terms, we retain all rights, title and interest in and to the Service and our intellectual property.

15. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not guarantee that:

  • the Service will be uninterrupted, timely, secure or error-free;
  • any defects or errors will be corrected;
  • exported files will always be compatible with every device, application or platform; or
  • AI-generated content or image processing results will be accurate, appropriate or free from objectionable material.

16. Limitation of Liability

To the maximum extent permitted by law, we and our directors, officers, employees, partners and agents will not be liable for any:

  • indirect, incidental, consequential, special or punitive damages; or
  • loss of profits, revenue, data, goodwill or other intangible losses, arising out of or in connection with your use of (or inability to use) the Service.

In any event, our total aggregate liability arising out of or relating to the Service or these Terms will be limited to the greater of:

  • the amount you paid to us for the Service during the three (3) months preceding the event giving rise to the claim; or
  • USD 100 (or the minimum amount required by applicable law).

Some jurisdictions do not allow certain limitations or exclusions of liability; in such cases, these limitations shall apply only to the extent permitted by applicable law.

17. Indemnification

You agree to indemnify, defend and hold harmless Canvix.io and our officers, directors, employees and agents from and against any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to:

  • your use of the Service;
  • your User Content;
  • your breach of these Terms; or
  • your violation of any law or third-party rights.

18. Termination and Suspension

You may stop using the Service at any time.

We may suspend or terminate your access to the Service (including your account) if:

  • you materially or repeatedly breach these Terms;
  • we are required to do so by law or by a court/authority; or
  • we decide to discontinue the Service.

Upon termination, your right to access and use the Service will cease. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability and indemnity) will continue to apply.

19. Changes to the Service and to These Terms

We may update or modify the Service from time to time. We may also revise these Terms. When we do, we will update the "Last updated" date at the top of this page and may provide additional notice where required by law.

If you continue to use the Service after revised Terms take effect, you will be deemed to have accepted those changes. If you do not agree, you must stop using the Service.

  • Your full name and contact information (including email address);
  • Identification of the copyrighted work you claim has been infringed;
  • Identification of the content on our Service that you claim is infringing (including the URL or other location details);
  • A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law;
  • A statement that the information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner�s behalf; and
  • Your physical or electronic signature.

We may remove or disable access to the reported content while we review the claim and may contact the user who posted the content for further information.
